Terms of Service

1. Agreement to these terms

These Terms of Service govern your access to and use of Obsid Pro, including the desktop application, the website at obsid.pro, and all related services. By accessing or using Obsid Pro in any way, you are entering into a binding agreement with these terms.

These terms apply to all users of Obsid Pro regardless of subscription tier or how you access the service. If you are using Obsid Pro on behalf of a company or organisation, you represent that you have the authority to bind that entity to these terms.

2. What Obsid Pro is

Obsid Pro is a Windows desktop application that enables simultaneous audio routing to multiple output devices including headphones and speakers. The software includes a ten band parametric equalizer, spatial audio processing with room calibration, the ability to import equalizer settings from images, and related audio features.

Obsid Pro currently runs on Windows 10 and Windows 11. Support for additional platforms is planned for future versions. We make no guarantee about the availability of features on platforms not currently supported.

The service is provided as a monthly subscription. Access to the software and its features is contingent on maintaining an active subscription in good standing.

3. Your account

To use Obsid Pro you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us at support@obsid.pro immediately.

Your account is personal to you. The Obsid Pro plan supports one user account. Obsid Pro Plus supports up to four user accounts under a single subscription. Each account must belong to a real individual. Creating multiple accounts to circumvent subscription limits is a violation of these terms.

You agree to provide accurate and complete information when creating your account and to keep your account information up to date. We may use your account email to send you important notices about your subscription, security, and significant changes to the service.

4. Subscriptions and billing

Obsid Pro is available in two subscription tiers. Obsid Pro is billed at ten dollars per month and includes a three day free trial for new subscribers. Obsid Pro Plus is billed at twenty five dollars per month with no trial period and is charged immediately upon subscribing.

All payments are processed by Dodo Payments. By subscribing you authorise Dodo Payments to charge your payment method on a recurring monthly basis until you cancel. Dodo Payments operates as a Merchant of Record and handles all payment processing, invoicing, and tax collection. Subscriptions renew automatically at the end of each billing period. You will be charged the applicable monthly fee on the same date each month unless you cancel before the renewal date. Prices are displayed in US dollars. Depending on your location, additional taxes may apply and will be calculated and collected by Dodo Payments at checkout.

We reserve the right to change subscription pricing with reasonable notice. Price changes will be communicated by email and will take effect at your next renewal date following the notice period.

5. Free trial

New subscribers to Obsid Pro receive a three day free trial. During the trial period you have full access to all features included in the Obsid Pro plan. You will not be charged during the trial period. After the trial ends, your subscription begins and you are charged ten dollars for the first month.

A valid payment method is required to start the trial. If you do not wish to continue after the trial, you must cancel before the trial period ends. Cancellation instructions are available in your dashboard at obsid.pro/dashboard.

6. Cancellation

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period. You retain full access to Obsid Pro until the end of the period you have already paid for. No partial refunds are issued for unused time within a billing period.

After cancellation takes effect, your account will lose access to subscription features. Your account data including equalizer presets and settings are retained for thirty days after cancellation in case you choose to resubscribe. After thirty days, your data may be permanently deleted.

7. Refunds

For Obsid Pro subscribers, the three day free trial exists so you can experience the full product before being charged. Because you have the opportunity to test the software before any payment is taken, refunds are not available after the trial ends unless a technical issue on our side prevents the software from functioning as described.

For Obsid Pro Plus subscribers, a refund window of seven days applies from the date of purchase. If you experience a technical issue caused by Obsid Pro that our support team cannot resolve within that window, you are entitled to a full refund. Refund requests must be submitted by contacting support@obsid.pro with a description of the issue.

Refunds are not available in the following circumstances. If the issue is caused by your hardware, operating system configuration, third party software, or user error rather than a defect in Obsid Pro itself, a refund does not apply. If you have used the software beyond the refund window without reporting an issue, a refund does not apply. If you are requesting a refund because you changed your mind, no longer want the software, or found an alternative, a refund does not apply.

All refund requests are reviewed individually. We aim to respond to all refund requests within forty eight hours. Approved refunds are processed through Dodo Payments and may take several business days to appear depending on your payment method and bank.

8. License to use Obsid Pro

Subject to these terms and maintaining an active subscription, Obsid Pro grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, and use the Obsid Pro software on devices you own or control for your personal use.

This license does not grant you any rights to the source code, underlying technology, or any intellectual property of Obsid Pro. The license is tied to your account and cannot be transferred to another person. If your subscription ends or your account is suspended, this license is automatically revoked.

9. Restrictions on use

You agree not to do any of the following in connection with your use of Obsid Pro.

You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the Obsid Pro software or any component of it. You may not modify, adapt, translate, or create derivative works based on the software.

You may not redistribute, sublicense, sell, rent, lease, or otherwise transfer the software or your subscription to any third party. You may not use the software to provide services to third parties on a commercial basis without our written permission.

You may not attempt to circumvent any technical measures in the software including subscription validation, device limits, or feature restrictions. You may not use automated tools, scripts, or programs to interact with the service in ways not intended by its design.

You may not use Obsid Pro in any way that violates applicable law or these terms. You may not attempt to gain unauthorised access to any part of the service or to systems or networks connected to the service.

10. Intellectual property

Obsid Pro, including the desktop application, the website, all visual design, brand assets, logos, feature names, and all underlying technology, is the exclusive property of Obsid Pro and its developers. All rights not expressly granted to you in these terms are reserved.

Nothing in these terms transfers any intellectual property rights to you. Your subscription gives you a license to use the software as described, nothing more. You may not use the Obsid Pro name, logo, or brand in any way that suggests endorsement or affiliation without our prior written consent.

11. Third party services

Obsid Pro uses Dodo Payments to process all subscription payments and billing. Dodo Payments operates as a Merchant of Record, meaning they are responsible for the financial transaction between you and Obsid Pro. Your payment information is collected and handled by Dodo Payments according to their own terms and privacy policy. We do not store your card details at any point.

By subscribing to Obsid Pro you are also subject to Dodo Payments terms of service. We encourage you to review their terms at dodopayments.com/terms before subscribing. Any billing disputes should be directed to Dodo Payments in the first instance.

12. Service availability and changes

Obsid Pro is provided as a version one product. We make reasonable efforts to keep the service available and functioning but we do not guarantee uninterrupted access. The service may be unavailable during maintenance periods, updates, or due to circumstances outside our control. Under periods of unusually high demand, server response times may be slower than normal.

We reserve the right to modify, update, add, or remove features from Obsid Pro at any time. We will make reasonable efforts to notify users of significant changes that affect core functionality. Minor updates, bug fixes, and improvements may be applied without prior notice.

We reserve the right to discontinue Obsid Pro with reasonable notice to subscribers. In the event of discontinuation, we will provide at minimum thirty days notice and will process prorated refunds for any prepaid subscription periods beyond the discontinuation date.

13. Disclaimer of warranties

Obsid Pro is provided on an as-is and as-available basis. To the maximum extent permitted by applicable law, we disclaim all warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the software will be error-free, that defects will be corrected, or that the software is free of viruses or other harmful components. We do not warrant that the software will be compatible with all hardware configurations or that it will meet your specific requirements.

14. Limitation of liability

To the maximum extent permitted by applicable law, Obsid Pro and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the software or service. This includes but is not limited to loss of data, loss of profits, loss of business, or any other commercial or financial loss.

Our total liability to you for any claim arising out of or related to these terms or your use of Obsid Pro shall not exceed the total amount you have paid for your subscription in the twelve months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Obsid Pro and its developers from and against any claims, damages, losses, liabilities, costs, and expenses including reasonable legal fees arising from your use of Obsid Pro in violation of these terms, your violation of any applicable law or regulation, or your infringement of any third party rights.

16. Governing law and disputes

These terms are governed by and construed in accordance with applicable law. In the event of a dispute arising from these terms or your use of Obsid Pro, we ask that you first contact us at support@obsid.pro to attempt to resolve the matter informally. We will make good faith efforts to resolve any dispute within a reasonable time.

If informal resolution is not possible, disputes will be resolved through binding arbitration or the courts of competent jurisdiction. Nothing in this section prevents either party from seeking injunctive or other equitable relief where appropriate.

17. Changes to these terms

We may update these terms from time to time to reflect changes in the service, legal requirements, or our business practices. We will notify you of significant changes by email to the address associated with your account and by posting a notice on the website.

Changes take effect on the date specified in the notice. Your continued use of Obsid Pro after that date constitutes your acceptance of the updated terms. If you do not agree with the updated terms, you may cancel your subscription before the changes take effect.
